COVID-19 Update:
The USPTO has temporarily extended the window for scheduling the registration examination. No action on the part of applicants is necessary.
For those applicants who have been admitted to take the registration examination and have an open scheduling window as of 05/01/2020, the scheduling window has been extended by 180 days.
For those applicants who are admitted to take the registration examination during the months of September and October, the scheduling window will be set to 240 days. -
Who needs to take the Patent Bar Exam?
The Patent Bar Exam is required for individuals wanting to practice before the USPTO in patent cases.
The requirements are the same for those seeking to become a patent agent or a patent attorney. -
Who is eligible to take the exam?
IMPORTANT: Before you start studying for the Patent Bar Exam make sure you meet all the eligibility requirements.
You must have the legal, scientific, or technical qualifications. Generally this is fulfilled by showing completion of a Bachelor's Degree in a Recognized Technical Subject, such as Science or Engineering.
If you are not a U.S. citizen and do not reside in the U.S. you may not be not eligible for the Patent Bar.

How is the exam administered?
The Patent Bar Exam is a computerized exam that is given at a testing location (Prometric Testing Center).
There are a total of 100 multiple-choice questions broken into two 3 hour sessions.
You will get 3 hours to answer the first set of 50 questions, an optional break of up to 60 minutes, and then another 3 hours to answer the second set of 50 questions.
To pass the exam you need to answer 70% of the questions correctly.
However, there are 10 beta questions that are not scored. Therefore you need to correctly answer at least 63 of the 90 scored questions to achieve a passing score of 70%.
Unofficial test results will be given immediately after finishing the exam. Official results will be mailed within 5 days or so. -
When is the exam offered?
The Patent Bar Exam is offered year-round via computer at test centers across the country and on a date and time chosen by the applicant.

How much does it cost?
There is a $110 non-refundable application fee and a $210 examination registration fee.
In addition, Prometric charges a separate $173 exam administration fee that is due at the time the testing appointment is scheduled.
